1. Purpose
1.1 North Carolina Central University (NCCU) Department of Police and Public Safety manages and enforces parking enforcement of laws, ordinances, and policies. The Parking Services office, within the Police Department, is responsible for providing parking services, and assists university police officers with traffic control, for all NCCU faculty, staff, students, and visitors.
2. Scope
2.1 Parking and operating a vehicle on the NCCU campus is a privilege extended by the University and is subject to North Carolina General Statutes and/or policies adopted by the NCCU Board of Trustees.
2.2 The NCCU Chief of Police, or their designee, may revoke parking privileges if a person seriously or habitually violates General Statutes and/or NCCU parking policy.
2.3 Vehicles parked on campus are at the owner’s risk. The University assumes no liability for vehicles parked on NCCU property or any property leased by NCCU.
3. Definitions
3.1 Unless otherwise specified, all terms used shall be those provided in NCGS Chapter 20, and other applicable sections of the North Carolina General Statutes, and applicable NCCU policies, insofar as they are provided.
3.2 Administrative sanctions: include, but are not limited to: tickets, parking charges, issuance of a ticket, and temporary or permanent revocation of parking permit and permissions.
3.3. Fire lane: any area specifically marked, striped, signed, and/or designated where vehicles are prohibited from parking, and/or any area in which direct and immediate access to a fire hydrant or firefighting apparatus would be blocked by a parked vehicle.
3.4 Handicapped/ADA space and permits: a parking space, including the access aisle designated for those issued authorized handicapped/ADA placards. All vehicles parked in Handicapped/ADA spaces must display either a handicapped license tag or other nationally recognized, approved, and active handicapped decal or placard.
3.3 NCCU Parking Services: the office designated by the NCCU Police Department whose duties include, but are not limited to: issuing and tracking parking permits and temporary parking devices, documenting vehicle parking registrations and permits, and maintaining records of parking violations and parking charges.
3.4 Parking permit: previously called a “decal,” “permit,” or “placard,” is the visible device issued by NCCU Parking Services. It must be displayed as instructed and only for the vehicle(s) registered with NCCU Parking Services.
3.5 Pay lot: any parking lot or area where payment for temporary parking is required based on the length of time the vehicle is parked or a flat rate payment for a specific event. Payments for these areas may be made via an automated pay machine, via a mobile app, or by attendants who collect the payment.
3.6 Registered vehicle: a vehicle that has been registered with NCCU Parking Services and is authorized to have and display a valid NCCU parking permit for the period noted.
3.7 Travel lane: that portion of the road, street, or way between the centerline and curb on which vehicles or bicycles are permitted to operate, but where parking is prohibited.
4. Authority and Delegation of Authority
4.1 The Chancellor is authorized to adopt and promulgate such rules and regulations and to establish such administrative procedures as they may deem necessary or advisable for the administration, interpretation, and enforcement of these parking policies, ordinances, and rules.
4.2 The Chancellor shall exercise their discretion and authority in such a manner as to ensure the proper conduct of the necessary business of the University, as well as the effective utilization and control of the available parking areas and facilities on the NCCU campus for the benefit and maximum convenience of faculty, staff, students, and visitors.
4.3 The Chancellor has delegated to the Chief of Police of the NCCU Police Department, or their appointed delegate, the responsibility for oversight, implementation, administration, and enforcement of the provisions of this Parking Policy.
4.4 The NCCU Police Department, under the supervision of the Chief of Police, or their appointed delegate and to the extent permitted by law, is authorized to enforce these parking rules and all applicable city, county, state, and federal laws.
5. Vehicle Registration and Permit Information
5.1 The NCCU Chief of Police (or their designee) shall establish procedures for registration of vehicles and distribution of parking permits. At the time of this policy’s publication, vehicle registration and payment of permit charges are processed online, via the “Parking” icon on myEOL.
5.2 Parking on campus is by permit only, in the designated lot, or specific spaces (for Reserved permit holders), noted on the permit, or by purchasing time-limited, temporary parking in the Latham Parking Deck or in applicable pay lots/spaces (e.g., ParkMobile).
5.2.1 Permit hangtags should be placed on the rearview mirror facing outwards and be displayed at all times while parking on campus.
5.2.1.1 If the vehicle does not have a rearview mirror, or the mirror mounting is such that the hangtag cannot be used, the permit must be displayed face-up on the dash on the vehicle’s passenger side.
5.2.1.2 Use of windshield shades, or other vehicle accessories, does not eliminate the requirement to have the parking permit displayed and visible even with the shade/accessories in-place.
5.2.1.3 Vehicles parked without a visible permit will be ticketed and may be towed at owner’s expense. If a vehicle has a valid permit, the Chief of Police (or their designee) may waive the ticket from the individual’s parking record, if successfully appealed, but any charges paid will not be refunded. If the vehicle was towed at owner’s expense, the registered owner of the vehicle remains responsible for the associated costs.
5.2.2 Except for Reserved permits, all other classes of permits do not guarantee a parking space in any specific area, lot, or space. Rather, it authorizes the decal holder to seek a parking space in an area approved for their permit type.
5.2.2.1 Spaces will not always be available at the desired locations, but during normal operations, parking spaces should be available on campus.
5.2.2.2 Students, non-reserved permit holders, and temporary permit holders should make maximum use of the Latham Parking Deck and the NCCU transportation/shuttle system.
5.2.3 NCCU designated parking spaces and lots (not counting for-purchase, temporary spaces) are for the use of the permit holders at all times and all days. Designated permit lots are not “open” or free for parking at any time, except as noted in this policy, for special occasions and limited times, when authorized by the Chancellor or their designee and announced via Parking Notices.
5.2.4 Vehicle operators shall obey the lawful instructions of any officer and of any official traffic sign or control device applicable thereto, unless otherwise directed by an officer.
5.2.4.1 These rules are in force whether or not specific traffic signs are used.
5.2.4.2 The responsibility of finding a legal parking space rests with the vehicle operator. Lack of space and/or lack of knowledge of this policy and parking rules are not a valid excuse for parking violations.
5.2.4.3 The NCCU Chief of Police shall be responsible for establishing, erecting, and maintaining all signs, signals, and markings necessary to implement this parking policy and the rules contained therein.
5.2.5 Motorcycles, motor bikes, and mopeds/scooters are motorized two- or three-wheeled vehicles capable of carrying a rider requiring North Carolina motor vehicle registration and licensing. These vehicles must purchase and display a valid parking decal to park on NCCU property.
5.2.5.1 The NCCU Parking Services office will advise operators of proper display of their parking permit, depending on the type of vehicle.
5.2.5.2 These types of vehicles must adhere to all parking rules and requirements contained in this policy, including parking in proper spaces.
5.2.5.3 Due to the smaller size of these vehicles, in lieu of towing, the NCCU Police Department may collect and impound these vehicles. Owners whose vehicles are impounded must pay applicable ticket and impounding charges prior to release of their vehicles.
5.3 All permits remain property of NCCU and must be returned upon request or upon separation from the University.
5.3.1 Employees who elected payroll deduction to pay for parking permits must complete the Payroll Deduction Cancellation Form upon permanent separation from NCCU.
5.3.2 Individuals remain responsible for payment until the permit is returned to the NCCU Parking Services Office.
5.3.3 Employees who were issued gate cards and/or electronic gate openers for NCCU areas must return those to the NCCU Police Department or Parking Office. Failure to return those items will result in billing for any parking charges and/or replacement and/or reprogramming costs.
5.3.4 Faculty, staff, or students who are away from NCCU for an extended period (e.g., sabbatical or study abroad) may elect to retain their parking permit, but all applicable charges and/or payroll deductions will continue. Employees who do not wish to continue paying for parking must return their permit and, if applicable, complete a Payroll Deduction Cancellation Form prior to departing, or the monthly deductions will continue. Permits paid in full for the term noted on the parking permit will not receive prorated refunds.
5.4 The new “parking year” begins on August 1, and annual permits will be valid until July 31 of the next year.
5.4.1 All eligible individuals may request a parking permit by submitting the NCCU Parking Permit Application via the Parking Portal or at the NCCU Parking Services office.
5.4.2 Eligible faculty, staff, and/or students must pay for the parking permit at the beginning of the parking period. Eligible faculty and staff may elect payroll deduction (not applicable for students or temporary employees).
5.4.3 Those who arrive at the university later, or decide later to request a parking permit, may do so, but parking permits may not be available. In order to ensure parking availability, Parking Services limits the number of permits for sale.
5.5 Permits may not be transferred, sold, or duplicated, forged, counterfeited, or altered in any way.
5.5.1 It is unlawful for any person to produce any facsimile or reproduction of a permit, sticker, decal or other device indicating eligibility to park on campus.
5.5.2 It is unlawful to steal or obtain a permit by fraud, deceit or trickery, willful misrepresentation of facts, purchase from another or gift from another.
5.5.3 It is unlawful for any person in lawful possession of a parking permit to alter, give, sell, transfer or attempt to transfer a permit to another person or to place on a vehicle other than that for which it is registered.
5.5.4 Those found in violation of Section 5.5 and its sub-sections will incur a parking charge and may have their parking privileges revoked temporarily (up to one year), or permanently for repeated violations.
Additionally, students who violate these provisions will be referred to Student Conduct & Community Standards.
5.3.5 If activities included violations of North Carolina statutes, violators will be subject to arrest and charges.
5.6 If parking charges are on the account, the requestor cannot obtain a new/updated permit without first paying the balance due.
5.7 Providing false or misleading information on a parking permit application will result in immediate revocation of parking privileges and forfeiture of all parking charges paid.
5.8 All permit holders must report lost or stolen permits and/or gate cards immediately to NCCU Parking Services.
5.8.1 All permit holders requesting a replacement permit and/or gate card must file a report with the NCCU Police Department and pay a processing charge to receive a replacement permit/gate card.
5.8.2 If the lost/stolen permit/gate cared is recovered and a replacement permit/gate card was issued, the permit holder must return the original permit/gate card to NCCU Parking Services or at the NCCU Police Department. In those cases, processing charges will not be refunded.
5.9 Handicapped/ADA Parking for Faculty, Staff, or Students
5.9.1 Faculty, staff, and students requesting a handicapped/ADA parking permit must submit a copy of their state-issued disability placard. The name of the person to whom the NCCU parking permit is issued must match the individual to whom the handicapped/ADA placard or license plate belongs.
5.9.2 Faculty, staff, and students with a state-issued disability license plate or hangtag must also have and display a valid NCCU parking permit issued by Parking Services—both must be displayed while parking in handicapped/ADA spaces.
5.9.3 A handicapped/ADA license plate and/or hangtag by themselves do not authorize non-NCCU permit-holders to park in the Handicapped/ADA spaces in NCCU permitted lots.
6. Parking Lots and Permit Classifications and Areas
6.1 Permit holders may register up to two vehicles with the Parking Services office or in the online system, and park with either vehicle.
6.1.1 Only one permit will be issued, and the permit must be displayed while parking. The permit holder is responsible for relocating the permit to the vehicle being driven on any given day.
6.1.2 Students may only register vehicles owned by them or by a member of their immediate family (e.g., parents or siblings). Students must register their vehicles by the first day of class each semester or by the first business day following arrival on campus.
6.2 Parking permits cannot be “lent” out to other employees, students, or visitors, in any way.
6.2.1. Any permit holder who lends out their parking permit and/or “badges-in” other individuals/vehicles into parking areas (e.g., the Latham Parking Deck) will be found in violation of parking policy/rules.
6.2.2 Permit holders of any type are not allowed to park and “hold” spots for others.
6.2.3 Lending out permits or parking in an area not associated with the issued permit can result in tickets, parking charges, towing, revocation of parking privileges, and/or forfeiture of pass and the funds paid for the pass.
6.3 Employee Reserved Permits
6.3.1 Reserved (red) permits entitle the holder and their registered vehicle(s) to one specific reserved space on campus twenty-four hours a day, seven days a week.
6.3.1.1 Exceptions may be made by the Chancellor, for high-need situations for distinguished visitor parking for specific events, with the most notable annual exception being parts of the BN Duke lot for graduation ceremonies. Parking Notices will be sent to the campus when such needs arise, and the Notice will identify the affected lots.
6.3.1.2 Reserved parking spots in lots designated for football parking and tailgating will not be available to Reserved holders during home football games. Those spots are excepted from the rule of 24/7 availability during game days. If faculty or staff members who occupy these spots are involved in football/gameday operations and would still use their spots on football game days, they must inform the Deputy Athletic Director and the Parking Operations Coordinator (via email) prior to July 1 each year of the need to maintain their spot access, or to have alternative parking access provided.
6.3.2 Reserved permit holders are not allowed to park in other lots/locations on campus, to include non-reserved areas, except for the Latham Parking Deck. Exceptions are granted for the Chancellor and their designated staff and/or guests during certain events in specific areas.
6.3.2.1 Should faculty/staff Reserved permit holders need to access alternative locations and lots for events/meetings, the event/meeting organizer must coordinate with NCCU Parking Services to request a limited number of time-limited exceptions to allow Reserved permit holders to park in Employee Non-Reserved lots. The coordination must be early enough to allow for Parking Services decisions and, if granted, preparations and for issuance of a campus Parking Notice.
6.3.2.2 For other events, meetings, or needs, the Chancellor may grant exceptions for limited times and places to allow Reserved permit holders to use other lots. Unless it is a short notice situation, for which the Chancellor’s Office will inform Parking Services, the Chancellor's Office will notify Parking Services of the need in enough time to allow for Parking Office preparations and issuance of a campus Parking Notice.
6.3.3 Per Section 5.2, Reserved permit holders only may park in their space, and they cannot be occupied except by the vehicle(s) registered in the parking system and displaying a valid permit for that space. Permits cannot be lent to others; Sections 5.5.3 and 5.5.4 apply.
6.3.4 Parking lots/areas with reserved spaces will have a “lot manager” who requests the spaces from the Parking Services office, which is the approval and issuing authority. The lot manager, in coordination with their appropriate senior leader (Dean/Associate Vice Chancellor or above) will recommend reserved spot assignments to the NCCU Parking Operations Coordinator for approval and permit distribution.
6.4 Employee Non-Reserved Permits (yellow) entitle the permit holder to park anywhere within the employee non-reserved zones twenty-four hours a day, seven days per week, except when designated lots/areas are closed for special events (e.g., graduation, football games, etc.) on specific days and times. Parking Notices will be sent via email to all NCCU employees and students to note when and where lots will be closed.
6.4.1 Any eligible faculty member, including Special Faculty, whose contracts are for one year or more, are eligible to purchase Employee Non-Reserved permits.
6.4.2 Adjunct faculty are considered temporary employees, and they may purchase Temporary Employee permits for the semester or session.
6.4.3 In previous years, NCCU provided certain NCCU retired employees (e.g., emeriti faculty) parking permits. These permits are no longer issued, but those granted the permits are still entitled to use them.
6.4.3.1 Retired permits are valid for all areas marked as Employee Non-Reserved areas/lots.
6.4.3.2 Retired permit holders must register their vehicles with NCCU Parking Services, and access to the Latham Parking Deck will be limited to those with active Eagle Cards.
6.5 Student Permits (blue)
6.5.1 Students may purchase permits, with full payment up-front, for the academic year (two primary semesters) or for only a specific semester.
6.5.2 Summer Session passes are sold separately.
6.5.3 Student parking permits are limited in number, to ensure that permit holders have available parking somewhere on campus, and are sold on a first-come, first-served basis.
6.5.4 The Latham Parking Deck is the primary location, and largest parking area available to students at NCCU. Students are highly encouraged to use the Latham Deck for parking and walk or utilize the NCCU Shuttle service/system for movement around campus.
6.5.5 All Student parking permit locations are listed on the NCCU Parking website, and students may park only in lots and areas designated for student parking.
6.5.6 Designated lots/areas may be closed for special events (e.g., graduation, football games, etc.) on specific days and times. Parking Notices will be sent via email to all NCCU employees and students to note when and where lots will be closed.
6.5.7 Students with valid student permits may park in Employee Non-Reserved (yellow) lot locations (special events dates/times excepted), from 7:00 p.m. to 6:00 a.m. daily.
6.5.7.1 Students who fail to move their vehicles by 6:00 a.m. (or by times designated for special event parking) may be ticketed (with parking charges applied) and/or towed at the owner’s expense.
6.5.7.2 No person shall park in a Reserved (red) space at any time, except for the designated permit holder for that space.
6.6 Temporary Employee Permits (Purple)
6.6.1 The temporary employee must provide verification of employment, which must include duration of employment at NCCU.
6.6.2 Temporary employees must pay the full amount due in advance via the NCCU Parking Portal. Temporary employees may not use payroll deduction to pay for parking passes.
6.6.3 Adjunct faculty are considered temporary employees and must purchase this parking permit category.
6.6.4 Temporary Employee permits are sold on a per-month or per-semester basis.
6.7 Visitor Parking and Pay lots/areas
6.7.1 Any vehicle not displaying a valid NCCU permit is considered a visitor and should use the Latham Parking Deck, or other metered/time-controlled temporary parking space. For the Latham Parking Deck:
6.7.1.1 Parking may be charged per hour or at pre-arranged per-event rates.
6.7.1.2 Parking validations may be distributed for certain events in order to obtain the per-event rate.
6.7.1.3 Lost parking validation tickets may incur additional expenses, and operators will pay at least one full day of charges at the normal parking hourly rate.
6.7.2 NCCU uses parking applications (e.g., Park Mobile) for other designated visitors/temporary parking, and these spaces/areas will have clear markings and designations.
6.7.2.1 All designated pay lot areas, such as Park Mobile, are not available for permit parking.
6.7.2.2 Anyone parking in these pay lots/areas must pay via the mobile app or applicable system.
6.7.2.3 Vehicles parked in these areas without an active, paid session, are subject to tickets, parking charges, booting, and/or towing at owner’s expense—this includes vehicles displaying a valid NCCU parking permit.
6.7.3 At times, pay lots may be controlled by attendants and/or automated gates or entry/exit devices and will be monitored by NCCU Police, Security, and/or Parking Enforcement.
6.7.3.1 It is unlawful for any person to deface, damage, tamper with, and/or willfully break, destroy or impair the usefulness of entry control devices.
6.7.3.2 It is illegal to bypass, or force open, an entry/exit device/gate.
6.7.3.3 Any person found violating these rules will be subject to applicable criminal charges, tickets, parking charges, and/or monetary costs to repair/replace damaged NCCU property.
6.7.4 Visitors who are guests of an NCCU department/division/office for the day or multi-day special events may obtain a daily parking permit. Individual visitors, or the sponsoring department/division/office must contact NCCU Parking Services for information on obtaining and paying for daily parking passes.
6.8 Special Event Parking (non-university-wide)
6.8.1 Departments/divisions/offices may request special event parking for visitors/groups via the Special Event Parking Request Form, available from NCCU Parking Services or on the website.
6.8.2 The completed Special Event Form and payment must be completed at least 10 days in advance to ensure parking is available and to allow Parking Notices to be sent to all faculty, staff, and students.
6.8.3 The Parking Operations Coordinator will assess the event date and time, balanced against the other parking priorities and availability, to determine the event parking location(s). The default location for special event parking is the Latham Parking Deck.
6.8.4 The Parking Operations Coordinator will provide the Special Event Parking permits upon completion of payment. The event’s sponsoring unit/personnel are responsible for distributing the permits to the guests/visitors.
6.8.5 All NCCU departments/offices/units will pay for their special event parking, unless they wish their visitors to pay the metered or a special event rate (for the Latham Deck).
6.8.6 The only exceptions for payment are NCCU events approved by the Chancellor, which includes: NCCU graduation ceremonies, Fall and Spring Eagle Preview/Open Houses, and JD Clement Early College High School graduation ceremonies.
6.9 University-Wide Special Events Parking
6.9.1 The NCCU Police Department may suspend enforcement of parking rules/regulations/policy to allow for special events on campus.
6.9.2 All temporary changes to NCCU parking rules and associated enforcement will be sent to NCCU faculty, staff, and students via a Parking Notice email.
6.9.2.1 The email will provide information, in text and graphics, on the designated lots/areas that are closed for special events, as well as the specific date(s) and times of the closure, as well as information on when vehicles must be removed from the noted areas.
6.9.2.2 Vehicles that fail to follow the notice for removing vehicles from the designated areas will be ticketed and may be immobilized or towed at owner’s expense.
6.9.3 These exceptions will be temporary and valid only for the dates and times noted in the Parking Notice.
7. No Parking Areas
7.1 It is unlawful for any person to park a vehicle on campus in any area or lot other than a space clearly marked or designated for parking. These areas include, but are not limited to: travel lanes, driveways, intersections, landscaped areas, and any location that blocks a pedestrian path, accessible route, or access aisle.
7.2 Additionally, the following areas are no parking zones/areas:
7.2.1 Fire Hydrants: parking in a manner that blocks access to any fire hydrant, regardless of the presence of special “fire lane” designation.
7.2.2 Barrier Posts: parking in front of removable barrier posts.
7.2.3 Emergency Access areas: clearly marked for fire lanes and/or emergency vehicle access.
7.2.4 Handicapped/ADA access: parking in a manner that blocks curb cuts, access paths or points for accessibility parking.
7.3 Vehicles in no parking areas, or parked in an area for which they do not have a permit, are not exempt from tickets or towing based upon having notes posted on/in their vehicle and/or having activated emergency flashers.
8. Parking Spaces and Restrictions
8.1 Vehicles must be parked in the manner and direction indicated by the parking markings and within the confines of the parking space. All parts of the vehicle (not just the tires) must be inside the designated parking space: generally, indicated by two white lines.
8.2 In order to allow parking enforcement via license plate reader systems, all vehicles must pull into the space—not backing in—and the license plate must be visible from the travel lane.
8.3 Vehicles in any parking space, lot, or any area on campus may not:
8.3.1 Be displayed for sale.
8.3.2 Have maintenance performed on it, to include washing by owners or mobile washing services. Emergency maintenance to allow the vehicle to be moved to a shop/garage is allowed, only if the vehicle remains in an approved, lawful parking space and has been reported to the NCCU Police Department as being disabled and needing emergency repair.
8.3.3 Use NCCU parking areas for long-term vehicle storage; such vehicles may be considered abandoned and applicable actions will be taken per this policy and NC General Statutes.
8.3.4 Have trailers, hitch-attached trays or larger storage/hauling racks attached, as they may block travel lanes and/or occupy more than one parking space.
8.3.4.1 Designated campus move-in days are exempted from this restriction, but only for the time needed to unload and in areas designated by NCCU Police, Security, and/or Parking Services.
8.3.4.2 Immediately after unloading, these vehicles with trailers or hauling attachments must be moved off campus.
8.3.5 Park a vehicle in any way or manner to prevent legal and free movement of other vehicles.
8.3.6 Park in any handicapped/ADA-marked space without displaying the proper and approved accessibility parking placards.
8.4 Violations of any of the above restrictions/rules will result in a parking charge and subject to immobilization or towing at owner’s expense.
8.5 Food truck vendors authorized by Campus Enterprises will be exempt from the parking space/area restrictions as needed for operations and only within the designated area.
8.5.1 Food trucks will display the appropriate NCCU-provided credentials.
8.5.2 Operators/workers associated with food truck operations are not allowed to park in the same area as the food truck. They must pay for, and park in, NCCU visitor parking (Latham Parking Deck or ParkMobile areas), or display parking validations provided by NCCU Parking Services or Campus Enterprises.
8.6 Any vehicle the NCCU Police Department designates as “abandoned” or “derelict,” under NCGS 20-137.7, will be removed from NCCU property.
8.6.1 Inoperable, abandoned, and/or derelict vehicles are also subject to ticketing, parking charges, immobilization, and/or towed at owner’s expense.
8.6.2 Abandoned and/or derelict vehicles are subject to provisions contained in, but not limited to, NCGS 20-137.6 to 20-137.13.
9. Enforcement, Citations, Tickets, and Parking Charges
9.1 NCCU Parking Services is authorized to collect parking charges for violations of this policy. NCCU Parking Services will maintain an approved list of parking charges, which is updated annually for the parking year, and approved by the NCCU Chancellor or their delegated authority.
9.2 For parking violations, the NCCU Police Department may issue citations or NCCU tickets.
9.2.1 Citations are for violations of NCGS Chapter 20 violations, such as (but not limited to), parking in Handicapped/ADA parking areas without valid credentials and parking in a fire lane. Only sworn police officers can issue citations. For parking violations where Chapter 20 is applicable, the officer may issue a citation or an NCCU parking ticket, at their discretion.
9.2.2 Violations of all NCCU parking policy and rules herein are subject to NCCU parking tickets, which may be issued by sworn officers or NCCU Parking Enforcement personnel.
9.2.3 The term “ticket” is used in this policy as the term covering parking violations, but it could also mean citations for Chapter 20 violations.
9.2.4 Parking tickets may be appealed (see appropriate section of this policy for additional information).
9.3 Faculty, staff, or students issued a parking ticket are responsible for parking violation charges for their registered vehicles.
9.4 For any vehicle not registered with NCCU Parking Services, the ticket will be billed to the registered owner of the vehicle (obtained from the NC Department of Motor Vehicles).
9.5 Parking tickets will be placed on the vehicle’s windshield and indicate the specific violation and associated parking charges.
9.6 NCCU Police Department will flag student records for outstanding/unpaid parking violations charges. Parking charges owed at the end of a semester may be included on the next student tuition and fees statement.
9.7 No faculty, staff, or student (including temporary employees) who have pending charges may receive a new NCCU parking permit.
9.8 At the discretion of the NCCU Police Department (to include Parking Services), violators of NCCU parking policy and rules may have their vehicle immobilized (booted, or similar device) or towed.
9.8.1 Towed vehicles may be recovered from the towing/storage company at vehicle owner’s expense. NCCU Parking Services will provide the towing company’s information to the vehicle owner to assist in recovery.
9.8.2 For immobilized vehicles, the vehicle owner is responsible for paying the immobilization removal charge, in addition to the parking charge and any outstanding charges (to include late penalties/charges) before the vehicle will be released.
9.8.2.1 Immobilization devices may only be removed by the NCCU Police Department (to include Parking Services enforcement officers).
9.8.2.2 Release of immobilization devices is available Monday through Friday, 8:00 a.m. to 5:00 p.m. Even if the vehicle owner/operator contacts the NCCU Police Department outside of these days and hours, the vehicle will not be released until the next business day.
9.8.3 Immobilization charges are not subject to appeal. Submission of an appeal does not substitute for payment of the immobilization device removal charge.
9.8.4 Immobilization devices may be used for vehicles parked illegally or legally at that time, but where the any of the following apply:
9.8.4.1 Non-payment of accrued parking and/or permit charges.
9.8.4.2 Unsatisfactory payment for previous parking charges, to include returned checks.
9.8.4.3 Display of a lost, stolen, revoked, or non-applicable NCCU permit.
9.8.4.4 Any other violation of this policy deemed appropriate by Parking Services, and in consultation with the NCCU Police Department.
9.8.5 Vehicles immobilized for more than forty-eight (48) hours may be towed from NCCU property.
9.8.5.1 The vehicle’s owner or custodian is responsible for all parking charges (to include any accumulated charges) and immobilization charges (payable to NCCU Parking Services) and all towing and storage charges (payable to the towing/storage companies).
9.8.5.2 The vehicle will not be released until all charges are paid in full.
9.8.6 In addition to immobilization removal charges, vehicle owners/operators will be responsible for any damage to the device and/or NCCU property caused by attempts/efforts to remove it or depart with it attached, up to replacement costs. NCCU is not responsible for damage to a vehicle where the operator tried to remove or drive away with an immobilization device still attached.
9.9 The NCCU Chief of Police (or their designee) may refer students who violate parking policy to the Office of Student Conduct and Community Standards.
9.10 Failure to settle outstanding parking charges can result in the University arranging for the collection of all assessed charges due.
9.10.1 These charges may include, but are not limited to: parking violation charges, immobilization removal charges, charges for returned checks/denied payments, and/or charges for damage to University property (including gate cards/openers).
9.10.2 Charges owed by students to Parking Services will be forwarded to Student Accounting for collection in the same manner as other debts owed to the University and may necessitate a “HOLD” status being placed with the University Registrar.
9.10.3 For non-students (faculty, staff, visitors), or students who have departed the University, NCCU Parking Services may forward the information to a collection agency to recover the debts and/or may be subject to garnishment of their wages and/or their North Carolina Income Tax Refund.
10. Suspension and Revocation of Parking Privileges
10.1 In addition to the application of parking charges, NCCU Parking Services may suspend or permanently revoke the parking privileges of any individual found in violation of any of the following:
10.1.1 Unauthorized use of a parking permit, to include “borrowing” of a permit and use on a vehicle not assigned to that permit.
10.1.2 Counterfeiting/forging and/or altering parking permits.
10.1.3 Presenting false or misleading information to obtain a parking permit or to resolve/appeal a parking violation.
10.1.4 Failure to pay/settle outstanding parking charges and debts.
10.1.5 Repeated violations of NCCU parking policy, to include chronic offenders. Chronic offenders are defined as an individual who exhibits an observable pattern of reoccurring parking violations without demonstrating a recognizable intent to self-correct the violating behavior.
10.2 Suspension timeframe will be recommended by NCCU Parking Services, with the final decision resting with the NCCU Chief of Police, and may be for up to one year.
10.3 Any suspension more than one year is considered a revocation of parking privileges.
10.3.1 Revocations will be recommended by the NCCU Chief of Police and reviewed by the first senior NCCU administrative leader above the Chief of Police.
10.3.2 The revocation may be approved or denied, with any denial reverting to up to a one-year suspension of parking privileges.
10.3.3 Anyone who had parking privileges revoked may request, in writing to the NCCU Chief of Police, return of parking privileges, but not before one year has passed since the revocation. The Chief of Police will review the request and make a recommendation to the first senior NCCU administrator above the Chief of Police.
10.4 Students who have their parking privileges suspended/revoked will be referred to the Office of Student Conduct and Community Standards by the NCCU Chief of Police (or their designee).
11. Petitions and Appeals
11.1 Individuals issued parking violations and other violation charges, restitution and/or suspension of parking privileges may petition the penalty within five (5) calendar days of the violation by completing an appeal within the Parking Portal.
11.2 The Parking Ticket/Citation Appeal Board:
11.2.1 Membership, consisting of faculty, staff, and students, is selected by the Chief of Police, and approved by senior University leadership (first administrator above the Chief of Police), with members updated annually and for the Parking Year (August 1 to the next July 31).
11.2.1 The Assistant Director of Public Safety will coordinate the Board dates and assist in conducting the meetings and Board actions, but is an ex-officio member for appeals decisions.
11.2.2 The Board will meet monthly, as schedules allow, to review appealed tickets and citation. If/when additional meetings are needed, the Assistant Director of Public Safety will coordinate them.
11.2.3 Appellants will be informed of the required information for the appeal to be heard. If the appellant fails to follow the information and guidelines, the appeal will not be heard.
11.2.4 Once the appeal has been heard and a decision made, notice is sent via email to the appellant informing them of the decision and any other required actions. If the appellant does not complete the requirements to finalize the appeal, the appeal will be vacated, and the ticket/citation will stand.
11.3 The decision reached by the Parking Ticket/Citation Appeal Board is final.
11.3.1 There are no further procedures available within the University to appeal the Parking Ticket/Citation Board’s decision.
11.3.2 If the appeal is denied, collection procedures will be initiated, and payment must be made, within fourteen (14) calendar days of the notice of denial.
